Terms and Conditions of Segway Adventure Sa Coma

Segway Adventure Sa Coma conducts guided Segway tours on defined routes approved by the relevant authorities.
To prevent accidents, all participants receive tested, multilingual safety instructions at the beginning of each tour. Should accidents nevertheless occur, all participating customers are expressly informed that participation in the guided tours, led by trained personnel, is at their own risk.
In detail:

The customer/tour participant is capable of operating and riding the Segway without assistance.

The customer/tour participant must inform the responsible tour guide of any health restrictions. These include pregnancy, skeletal operations including implants, and operations on tendons or muscles of the musculoskeletal system performed less than 6 months prior.

The consumption of alcoholic beverages (including residual alcohol) and all intoxicating substances is strictly prohibited without exception. Even suspicion alone is sufficient for exclusion from the tour by the responsible guide. Alcohol and drugs are also prohibited during the tour. Consumption during the tour leads to immediate exclusion.

Participation in the safety briefing is mandatory, regardless of prior experience. No briefing = no participation.

Helmets are mandatory for the entire duration of the tour. Segway Adventure provides helmets, or the customer must bring a suitable helmet.

The customer/tour participant is obliged to use the Segway properly. During the tour, participants must ride within the group at the position assigned by the guide and follow the designated route.

In case of a fall, “human before machine” always applies without exception. This means that in the event of an imminent fall, the participant must release the Segway as early as possible.

Traffic regulations (StVO) apply as they do for bicycles.
Contract Conclusion / Bookings / Cancellation

The tour contract becomes binding when the customer makes a booking electronically or in one of the two stores.

Segway Adventure expressly reserves the right to combine tours or reschedule them in coordination with participants. This applies in particular in cases of rain, power failures, or other events requiring rescheduling.

Before the tour begins, the participant must pay the displayed or agreed tour price. Payment after the tour is not permitted.

Cancellation despite a binding booking is only possible up to 24 hours before the tour. Later cancellations (less than 24 hours before the tour) result in a charge of 50% of the agreed price.

All advance payments made via authorized resellers must be reclaimed by the customer from their point of payment if cancellation occurs within the allowed timeframe. In case of cancellation less than 24 hours before the tour, Segway Adventure will charge the full 50% cancellation fee against these payments.

If the customer decides not to participate after the briefing but before the tour starts, the tour price paid to Segway Adventure will be refunded. Advance payments made to authorized resellers are excluded and must be claimed by the customer directly.
Liability / Tour Procedure / Recommendations

These terms and conditions are available at Segway Adventure offices. Participation in the tour is only possible with written confirmation of acceptance of these terms.

The tour guide may change the route at any time for any reason. Claims for financial compensation due to route changes are excluded.

Instructions given by the tour guide must always be followed. In case of repeated violations, endangering others, or unsafe riding behavior, the guide may exclude the participant from the tour. The Segway will be turned off, and the participant must return on foot.

The participant is liable for all damage caused to third parties, whether personal injury or property damage. Liability by Segway Adventure or its guides is excluded, except in cases of proven gross negligence or intent.

Proper footwear is required. Participants wearing flip-flops, pumps, or high heels are excluded from the tour. Segway Adventure strongly recommends weather-appropriate clothing. Physical warming through movement is not possible on the Segway.
Data Protection (GDPR)
Scope of processing personal data
We process personal data of our users only insofar as this is necessary for the provision of a functional website and our services. Processing is usually carried out only with the user’s consent, except where legal provisions allow otherwise.

Data deletion and storage duration
Personal data is deleted or blocked once the purpose no longer applies, unless legal retention obligations require storage. Data is also deleted or blocked after expiry of legal retention periods unless further storage is required for contract purposes.
Miscellaneous
If any provision of these terms is found to be invalid, the remaining provisions remain unaffected.
Place of performance and payment is the current registered office of Segway Adventure.
Jurisdiction is agreed to be Manacor, Mallorca, Balearic Islands, Spain.
